Terms of use

Terms of Use

These Terms of Use ("Terms") are an agreement between you and Luke Rouse, the operator of Flare in Australia ("Flare", "we", "us" or "our"). They govern your access to and use of the Flare mobile application, website and related services.

By creating an account or deliberately accepting these Terms in Flare, you agree to these Terms, the Privacy Policy and the Community Standards. If you do not agree, do not use the ordinary app features. You may still review the policies, sign out and permanently delete your account.

1. Eligibility and account security

You must be at least 18 years old and legally able to enter into these Terms. You must provide accurate account information, keep your credentials secure and not allow another person to use your account.

02

2. What Flare provides

Flare helps adults discover and host short-lived local plans, request to join, coordinate with accepted participants and form mutual connections. Hosts choose their plan and decide whether to accept a request. Flare provides the digital service but does not organise, supervise or attend member-created plans.

Flare does not verify or guarantee a member's identity, statements, conduct, suitability or intentions, or the availability, legality or condition of a venue or activity. Flare does not guarantee that a plan will proceed or produce any particular social, safety, health or other outcome.

Flare is not an emergency service. In Australia, call Triple Zero (000) when urgent police, fire or ambulance help is required.

03

3. Location and private meeting information

Flare uses foreground location only when needed for a feature you choose. It does not provide continuous or background tracking. A flare represents a fixed meeting point or approximate area, not a person's live location.

Before acceptance, eligible members see an approximate, intentionally offset public area. Exact meeting coordinates, venue, address and arrival instructions are private meeting information available only while server access rules allow it. You must not attempt to infer, scrape, expose or misuse another person's location or private meeting information.

04

4. Your conduct

You must comply with the Community Standards and applicable law. In particular, you must not:

  • use Flare if you are under 18 or use it to arrange contact with minors;
  • impersonate another person or misrepresent a profile, flare, activity, venue or meeting point;
  • harass, threaten, stalk, intimidate, sexually pressure or exploit another person;
  • promote violence, hatred, discrimination, scams, illegal activity or dangerous conduct;
  • share another person's private information, content or exact location without permission;
  • spam flares, requests, connections, messages, reports or support channels; or
  • scrape, automate access to, interfere with or bypass Flare's authentication, safety, privacy, moderation or security controls.

A request, acceptance, connection or message never implies consent to another interaction. Respect declines, removals, blocks and requests to stop contact immediately.

05

5. Hosting and attending

Hosts are responsible for honest plan information, a suitable meeting point, request decisions and cancelling or updating a plan that cannot proceed as described. Participants are responsible for reviewing available information and making their own attendance and personal-safety decisions.

Use your judgment, consider public venues, tell someone you trust about your plans, protect your belongings and leave whenever you feel uncomfortable. These suggestions do not guarantee that a meeting will be safe.

06

6. Your content

You retain ownership of profile text, photos, flare details, messages, feedback and other content you submit ("Your Content"). You give Flare a limited, non-exclusive licence to host, store, reproduce, process and display Your Content only as reasonably needed to operate, secure, moderate and improve the service according to these Terms and the Privacy Policy.

You confirm that you have the rights and permissions needed to submit Your Content and that it does not infringe another person's rights.

07

7. Reports, moderation and enforcement

Flare may review reports and available contextual records; restrict content or features; issue warnings; suspend or ban accounts; cancel hosted flares; and preserve relevant records when reasonably necessary to enforce these Terms, protect members, investigate incidents or comply with law.

Moderation decisions may rely on incomplete or disputed information. We will use reasonable efforts to apply the rules consistently, but do not promise immediate review or a particular outcome. Questions about an account action may be sent to support@flare-social.com.au. Feedback and ordinary support are not safety-reporting or emergency channels.

08

8. Feedback and diagnostics

Product feedback is optional. If you permit follow-up contact, we may use your registered email to discuss that submission. Flare may send privacy-minimised crash and error diagnostics needed to identify unexpected failures. The information included, excluded and retained is described in the Privacy Policy.

09

9. Third-party services and availability

Flare relies on third-party providers for functions such as authentication, hosting, storage, email, maps, notifications and error reporting. Their availability and terms may affect parts of the service.

The service may contain defects, change, be interrupted or become unavailable. Features and supported areas may be added, removed or changed when reasonably necessary for safety, security, compliance or operation. We will not use this clause to remove rights that cannot lawfully be excluded.

10

10. Intellectual property

Flare's software, branding, design and service content, excluding Your Content and third-party material, are owned by or licensed to Flare's operator. You receive a limited, personal, non-exclusive, non-transferable and revocable right to use the service for its intended purpose. You may not copy, sell, sublicense, reverse engineer or create derivative works from protected parts of the service except where applicable law permits it.

11

11. Account closure and deletion

You may stop using Flare, sign out or permanently delete your account from Profile & Settings. You may also begin an ownership-verified deletion request at https://flare-social.com.au/account-deletion.

Account deletion removes the account, profile, photos and ordinary social activity as described in the Privacy Policy. It does not shorten applicable limited event-safety, incident, moderation or legal retention periods.

12

12. Consumer rights, questions and changes

Nothing in these Terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

Contact support@flare-social.com.au with a question or complaint. The parties should first try to resolve a dispute in good faith through that channel. The governing law and forum require confirmation by Australian counsel before this document is approved.

We may update these Terms as Flare's features, risks, legal obligations or operating model change. The current version and effective date will be published at https://flare-social.com.au/terms. Flare will show an updated version and seek renewed acceptance when required rather than accepting it for you.
